These Terms of Use ("Terms") govern your use of the Pocastock mobile application and website (collectively, the "Service") operated by Pocastock ("we", "us", or "our") at pocastock.com. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
Pocastock is a K-pop photocard identification and collection management application. The app allows users to:
- Scan or photograph K-pop photocards to identify the member, album, and rarity
- View market price data for identified photocards
- Manage a personal photocard collection stored locally on their device
3. Eligibility
You must be at least 13 years old to use this Service. By using Pocastock, you represent that you meet this age requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
4. Acceptable Use
You agree to use Pocastock only for lawful purposes. You must not:
- Use the Service for any unlawful purpose or in violation of any regulations
- Attempt to reverse-engineer, decompile, or disassemble any part of the app
- Use the Service to transmit spam, malware, or any harmful content
- Attempt to gain unauthorized access to our systems or infrastructure
- Scrape, crawl, or systematically extract data from the Service
- Resell or commercially exploit the Service without written permission
5. Intellectual Property
All content, design, code, and branding in the Pocastock app and website are the property of Pocastock and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
K-pop artist names, group names, and photocard images are the intellectual property of their respective rights holders. Pocastock does not claim ownership over any third-party intellectual property referenced in the app.
6. Price Data and Information Accuracy
Market price data provided by Pocastock is sourced from third-party marketplaces and is intended as a general reference only. We do not guarantee the accuracy, completeness, or timeliness of price information. Do not rely solely on Pocastock data for financial decisions.
7. User Content
Images you submit for scanning are processed temporarily for identification purposes only. As described in our Privacy Policy, uploaded photos are automatically deleted within 24 hours and are never stored permanently or shared with third parties.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Photocard identification results will be 100% accurate
- Price data will reflect current market conditions
- Any defects will be corrected
9. Limitation of Liability
To the maximum extent permitted by applicable law, Pocastock and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of or inability to use the Service.
Our total liability for any claim arising from use of the Service shall not exceed the amount you paid (if any) for the Service in the twelve months preceding the claim.
10. Third-Party Services
The Service may reference or link to third-party websites or services (such as K-pop marketplaces). We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is governed by their respective terms.
11. Changes to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
